A. Cancellation Policy

Introduction

Consumers have a right of cancellation in accordance with the following provisions. A consumer is any natural person who enters into a legal transaction for purposes that are predominantly outside their trade, business or independent professional activity.

Right of Cancellation

You have the right to cancel this contract within fourteen days without giving any reason.

The cancellation period is fourteen days from the day on which you, or a third party designated by you who is not the carrier, took possession of the last item of goods.

To exercise your right of cancellation, you must inform us (Spinnax GmbH, Haldenhofstraße 12, 78351 Bodman-Ludwigshafen, Germany, Tel.: +49 7773 22 89 88 18, E-mail: info@spinnax.com) of your decision to cancel this contract by means of a clear statement (e.g. a letter sent by post or an e-mail). You may use the attached model cancellation form for this purpose, although this is not mandatory.

You may also exercise your right of cancellation online via the website at https://spinnax.com/widerrufsbelehrung/. If you use this online function, we will immediately send you an acknowledgement of receipt on a durable medium (e.g. by e-mail), containing information on the content of your cancellation declaration as well as the date and time of its receipt.

To meet the cancellation deadline, it is sufficient for you to send your communication concerning your exercise of the right of cancellation before the cancellation period has expired.

Effects of Cancellation

If you cancel this contract, we shall reimburse all payments received from you, including the costs of delivery (with the exception of any additional costs resulting from your choice of a type of delivery other than the least expensive type of standard delivery offered by us), without undue delay and no later than fourteen days from the day on which we receive notification of your cancellation of this contract.

We will make the reimbursement using the same means of payment as you used for the original transaction, unless expressly agreed otherwise with you. In no event will you incur any fees as a result of this reimbursement.

We may withhold reimbursement until we have received the goods back or until you have provided evidence that you have returned the goods, whichever occurs first. You must return or hand over the goods to us without undue delay and, in any event, no later than fourteen days from the day on which you inform us of your cancellation of this contract. The deadline is met if you send the goods before the fourteen-day period has expired. You shall bear the direct costs of returning the goods. For goods which, due to their nature, cannot normally be returned to us by post (freight-forwarded goods), the direct return costs are estimated at a maximum of approximately EUR 40 for each such item.

You are only liable for any diminished value of the goods resulting from handling them in a way that is not necessary to establish the nature, characteristics and functioning of the goods.

Exclusion or Premature Expiry of the Right of Cancellation

The right of cancellation does not apply to contracts for the supply of goods that are not prefabricated and for the manufacture of which an individual choice or decision by the consumer is decisive, or which are clearly tailored to the consumer’s personal requirements.

The right of cancellation does not apply to consumers who, at the time the contract is concluded, are not nationals of a Member State of the European Union and whose sole place of residence and delivery address are outside the European Union at the time the contract is concluded.

General Information

1. Please avoid damaging or soiling the goods. Please return the goods to us in their original packaging, including all accessories and all packaging components. If necessary, please use protective outer packaging. If you no longer have the original packaging, please ensure that the goods are adequately protected against transport damage by using suitable packaging.
2. Please do not return the goods to us carriage forward or with postage due.
3. Please note that compliance with points 1 and 2 above is not a prerequisite for the effective exercise of the right of cancellation.
